is there a 10 yr. grandfather clause. it is doing property damage to my driveway, i have a handicap child so we plan to put a cement driveway but i need his car port moved. all the rain water drains at least 1 foot over on my property. code compliance says civil court matter. is there a clause on how long the car port has been there. it is in very poor shape, fell once barely standing now. we are in texas. i have pictures and video of the rain and the damage. do i have a case

If he built on your property, then you have the right to have it removed. Your property is your property and a 10 year grandfather clause, if there is one, would not apply. Your property deed and city/county property and tax records will provide proof of ownership.
If he belly aches about it, then ask your neighbor for a copy of car port's building permit and proof he owns the property.
Reply:You had better act now. The longer you allow him to remain on your land the stronger his position becomes. In fact, if he goes to court first, the court could award him the land under an "adverse possession" claim.
Reply:If it is definitely on your property, give him notice to remove it. ~
If he doesn't, rent a bulldozer and move it yourself onto his property. Then the ball is in HIS court and he'll have to decide if he wants to sue you.
Check local law for statute of limitation, IF an ungranted use of your property gives rights (easement) to the trespasser after a given length of time.
Reply:How long you owned the property is irrelevent. The important question is how long is how long the car port has been there.
Assuming there is a 10 year statute of limitation for tresspass to land (it vary state by state, I have no idea what it is in TX) and the carport has been there for more than 10 years your neighbor now owns that land throught adverse possession.
You might have a case, contact an atty in Texas.
Do not rent a bulldozer and do it yourself.

Survey: Having a dent in your car, how do you feel about it ?
Some people hate even the smallest dent in their car, others do not care too much, again others might feel it gives the car character, uniqueness or may even look cute. What are your thoughts, how do you feel about it ?

Oh you dont even wanna know....driving down a street where there is a grocery store...well to get in the grocery store theres a large hill. Well as i am driving 40 miles per hour down the road past this hill to the grocery store out comes this grocery cart down the hill towards me. It slammed into the back passenger door and basically caved it in. Yeah lets just say that i am not in the least bit happy about it. And the grocery store says they wont pay for the damage because it wasnt on their property and there are signs posted for them not being responsible for carts being left un attended...well im still fighting with them over that!!!

Buy more efficient car
Public Transportation
Sacrifice other activities financially to compensate for budget constraints

Survey: How much would you be willing to spend (maximum) on gasonline (in US dollars)?
I have 2 children so I need my car and would spend whatever gas costs to do what I need to do.
My car is paid off, pretty good on gas and I don't want a new bill so I wouldn't buy another car just for more gas mileage.
Public transportation doesn't exist where I live unless I walk for 3 miles to the stop and that can't happen, never mind trying to lug 12-15 bags of groceries home on a bus with a 3 yr old, it just doesn't make since.
Sacrifice other activities? I do so little extra trying to live responsibly that I don't have much to give up.
I recycle and do what I can so my final answer is that I would pay for gas no matter how much it cost because it is just like a roof over my head, a necessity.
Reply:I would pay just about the max we pay now $3/gallon, but I would also stop driving to random places on weekends, up the coast for "some air", and would start shopping or running errands all at once instead of here and there.
I live in LA where there is a somewhat decent public transportation system.
-To get to my job 3 miles away I would have to take 3 buses and it would take about an hour due to the route schedule.
- I could ride a bike, but frankly I'm scared I'd get run over
- Based on my work schedule I would have a hard time finding a carpool buddy, but it would not be impossible
-I could walk but don't want to because I'm lazy, I admit it, plus I work the afternoon/evening shift and would have to walk home in the dark or catch the buses in the dark.
If I worked somewhere whee they had a carpool program or reimbursed for public transportation and a bus stop outside I'd do it, but right now all the driving I can afford to save is the recreational driving, not get to work commuting.

A more efficient car might be the way to go; however, if it means getting a very small car, then the chances of dying or being seriously injuried in an auto accident also rise. Public transportation in many cities is out of the question, due to poor planning on the part of the cities providing it. It is also not always reliable, and the stations are often frequented by those of dubious nature. One must also consider family matters when using public transportation or carpooling. It is not always possible to respond quickly should an emergency arise and one needs to reach home. If it is imparative to have a vehicle, and a necessity to drive it to work or elsewhere, then budget constraints appear to be the most logical option.

I'd like to buy a more efficient car but I don't have the money, and taking the bus would cut into my time. So.....I'd have to say $8.00? I dunno I would probably only do important driving.

We all depend on our cars to get us where we need to go. We might not joyride as much as we would like but we still have places we need to go and not everyone will ride public transportation. Geez, i live in the same town as the second biggest Air Force Base in America and I don't think we even have public transportation. I know I would never ride a bus. I have an Escape ( an SUV) and yes the gas sucks but i still drive and fill it up and drive and fill it up...

I would not drive as much, cut-back on my road trips. Turn the a/c off. Empty the trunk so that the only weight is the car and myself.
I already have a small car and would never get a MONSTER/BULLY TRUCK/GAS GUZZLER. All those fools with massive cars are paying up the you know WHAT for gas, their choice.
